Today, President Trump released a memorandum to persecute attorneys and law firms who sue the Federal Government. I do not need to repeat Trump's opposite-land history with the truth, nor his litigious nature in which his lawyers lie, and lie some more.
Trump is losing most of the lawsuits for all the illegal actions he is taking in his second term, and is seeking to frighten lawyers and firms from suing the goverment over his actions.
In particular, the memorandum cites lawyers winning immigration suits, but it doesn't limit action only against immigration lawyers. Instead, it orders the Attorney General to investigate firms who have brought suits against the government in the last 8 years and persecute any firm or attorney that Trump or his administration view as frivolous and aimed at controverting the rule of law.
The administration has well over 100 lawsuits currently in the queue in only 2 months. A summary of these suits reveals the following (this is a high level list and is certainly not comprehensive):
- Trump's invocation of the Alien Enemies Act, not in time of war.
- His attempt to end birthright citizenship for the newborns of immigrants with lawful status.
- Numerous actions taken by DOGE.
- Firings of federal employees without due process.
- The breach of highly sensitive data by DOGE.
- Trump's firing of people in independent watchdog departments.
- Trump's dismantling of USAID.
- Trump's dismantling of the Department of Education.
- ICE detaining people at public schools.
I believe Trump hopes to persecute the lawyers involved with suits like this, so that people will stop suing the administration when Trump does illegal things.
In the last week, Trump signed an executive order to review and remove all federal support and funds from the law firm Paul, Weiss, Rifkind, Wharton & Garrison LLP for lawsuits against both Trump and his administration. I am not certain what contracts the firm had that it was paid with federal funds, but this created a reverse course in the firm, and they aligned themselves with Trump, and he rescinded the order.Persecution of lawfirms works. They will align themselves with whatever Trump wants.
